How to Apply for a KITAS and Work Permit in Indonesia

When all the paperwork on your visa is done, you will be issued a Limited Stay Permit - Kartu Izin Tinggal Terbatas, better known as a KITAS card. The predecessor to the KITAS was the KIM/S. People still erroneously refer to the limited stay permit as a KIM/S.

With your KITAS you will also receive a Blue Book, Buku Mutasi.

The blue book tracks changes in your immigration status. They are valuable documents and should be kept safely. The KITAS card & blue book allow you to live in Indonesia for one year and may be renewed annually, up to two extensions without having to leave the country.

The Indonesian foreign and domestic investment laws allow the employment of expatriate personnel in positions that cannot be filled by Indonesian Nationals. A company wishing to employ an expatriate must, after having obtained the approval of the government (in the form of SPT or SPPP), do the following :

Prepare a "Manpower Utilization Plan" (RPTK) for submission to BKPM for validation.

Based on validated RPTK, submit of application for a permit to utilize foreign personnel. Work permits for foreign personnel (IKTA) are issued by the Regional Investment Coordinating Board (BKPMD), based on the RPTKA (for foreign personnel) and letter of recommendation (TA-01) issued by Investment coordinating Board (BKPM).

BKPMD issued the work permit for the Chairman of BKPM and on behalf of the Minister of Manpower. The permit may be for a year or for a shorter term to allow for irregular visits by an expatriate working in Indonesia (e.g. for a week, a month or two months).

It is possible to extend the work permit as long as all the requirements are fulfilled. The expatriate should have KIM (Entrance Permission) and STMD (letter for reporting himself to the police). The expatriate can be live and work in Indonesia as long as stated in the Manpower Utilization Plan (RPTK).

If more time is needed than originally stated in the RPTK, the person should follow the EPO (Exit Permit Only) procedure if they want to work again.

Foreign Property Ownership in Indonesia, to be Extended to 70 Years

Foreign property ownership will be extended from 25 years to 70 years. “The regulations formulation is completed. It only waits for the Housing Minister stamp,” said Lucy Rumantir, Jones Lang LaSalle Indonesia Chairman, in a press conference at the Nikko Hotel in Jakarta, yesterday.

Lucy, who is also the Permanent Committee Head of Property Services for the Indonesian Chamber of Commerce and Industry (Kadin), is one member of the team who formulated Government Regulation (PP) No. 41/1996. Under this regulation, foreigners could only own a house for 25 years. According to Lucy, Indonesian properties occupancy rates are not optimal yet because of the government limitation. Under this PP, foreigners can only own a home or flat built on land with a right to use (Hak Pakai) certificate.

Foreigners complained that while Indonesians could easily own houses abroad, but it is difficult for them to get houses in Indonesia. Whereas regulations on property ownership in other big cities in the world was easier.

She cited that in Australia, foreigners could own a house just by having a passport. But they could only buy new houses.

“Later, step by step, we will formulate a regulation to allow right to use land become
right to build land (Hak Guna Bangunan),” said Lucy. Besides that, to smooth out foreign property ownership, the revision includes limitations.“For example, foreigners could only own properties above Rp1.5 billion,” she said.

Lucy added that if more foreigners buy properties in Indonesia, state revenues will increase. According to her notes, the number of foreigners in Indonesia is 83,000 people. If just one percent of them buy properties, this translate to 800 people. “800 times Rp1.5 billion, it’s quite a big revenue for Indonesia,” she said.

That does not include other impacts. If demand is higher, property development will also increase. “From there, demand for curtains and furniture will increase,” said Lucy. This means that other industries, such as textile and furniture, will also grow.

New Immigration Bill Passed in Indonesia

New immigration bill has been passed by the Indonesian House of Representatives on April 7, 2011 which will affect expat spouses (women or men) who are married to Indonesian nationals (men or women). The new law is expected to be signed by President Susilo Bambang Yudhoyono (Pres SBY) within 30 days.

  • Foreign spouses of Indonesian citizens can get a permanent residence permit (Kitap) after two years of marriage. They will only be required to report to the immigration office once every five years — a free service — instead of the annual renewal currently required.
  • If they have been married to an Indonesian citizen for at least 10 years, foreigners can stay in the country even after a divorce.
  • Foreign spouses will be allowed to work in the country.
  • Children from mixed marriages will automatically get a Kitap regardless of their nationality. Under the current arrangement, these children have to choose a citizenship at the age of 18. If they choose to adopt foreign citizenship, they have to apply for a residence permit.
  • Foreign investors who have worked in Indonesia for three years, less than the five years now required, can get a Kitap.
  • Former holders of Indonesian citizenship can get a Kitap.
